Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of tidal-takes.com and the Tidal Takes membership (the "Service"). By creating an account or subscribing, you agree to these Terms. If you don't agree, please don't use the Service.

1. Acceptance of terms

By accessing tidaltakes.co, creating an account, or subscribing to a membership, you confirm that you're at least 18 years old (or the age of majority in your jurisdiction) and able to enter a binding agreement, and that you agree to be bound by these Terms and our Privacy Policy.

2. The service

Tidal Takes provides a subscription-based library of ocean and coastal video content ("Clips") for use in members' own content, including social media, marketing, and creative projects, subject to the licence terms in Section 5.

We add new Clips regularly, but we don't guarantee any specific volume, frequency, or type of content will be added in a given period.

3. Accounts

  • You must provide accurate information when creating an account and keep it up to date.

  • You're responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

  • Each membership is for a single individual user. Accounts may not be shared, sold, or transferred.

  • Notify us immediately if you suspect unauthorised use of your account.

4. Membership & billing

Subscriptions. Membership is billed on a recurring basis — monthly or annually, depending on the plan you choose — via our payment processor, Stripe. By subscribing, you authorize us to charge your chosen payment method on a recurring basis until you cancel.

Price changes. We may change subscription pricing from time to time. Changes will apply to new members immediately and to existing members only from their next renewal after we provide notice. Members who joined at a promotional or legacy price will not see it changed retroactively for a billing period they've already paid for.

Cancellation. You may cancel your subscription at any time through your account settings or by contacting us. Cancelling stops future billing; your access continues until the end of the period you've already paid for.

Refunds. Because library access is granted immediately upon payment, subscriptions are generally non-refundable. We may make exceptions at our discretion — contact us if something has gone wrong and we'll review it in good faith.

Failed payments. If a renewal payment fails, we may suspend your access until payment is resolved, and may retry the charge automatically.

5. Licence to use content

Subject to your membership remaining active (or, for Clips already downloaded, subject to the terms below), we grant you a limited, non-exclusive, non-transferable licence to download and use Clips as follows:

  • Use in your own social media content, marketing, websites, and creative projects, including monetised and commercial use (sponsored posts, paid ads, client work), unless otherwise stated for your specific plan.

  • Edit, colour-grade, trim, remix, and otherwise modify Clips as part of your own content.

  • Continue using any Clip you downloaded while your membership was active, even after you cancel — the licence for downloaded Clips survives cancellation.

You may not:

  • Resell, sublicense, or redistribute Clips as stock footage or in any competing content library, whether modified or not.

  • Claim exclusive ownership or copyright of unmodified Clips.

  • Share your account or downloaded raw Clip files in bulk with non-members.

  • Use Clips in any way that is unlawful, defamatory, or infringes on the rights of others.

This is a shared library — other members may also use the same Clips. We're not responsible for similarities between members' content arising from shared use of the library.

6. Prohibited uses

In addition to the content restrictions above, you agree not to:

  • Attempt to circumvent our membership paywall or access the Service without a valid subscription

  • Use automated tools (bots, scrapers) to access or download content in bulk beyond normal use

  • Attempt to interfere with, disrupt, or reverse-engineer the Service

  • Use the Service for any unlawful purpose

  • Impersonate any person or misrepresent your affiliation with Tidal Takes

Violating these Terms may result in suspension or termination of your account without refund.

7. Intellectual property

All Clips, the Tidal Takes name, logo, and website design are the property of Tidal Takes or its licensors and are protected by copyright and other intellectual property laws. Except for the licence granted in Section 5, nothing in these Terms transfers any ownership rights to you.

8. Third-party services

The Service relies on third-party providers, including Squarespace (hosting), Stripe (payments), and file-hosting providers for Clip delivery. We're not responsible for outages, errors, or issues caused by these providers, though we'll work to resolve disruptions where we can.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. We don't guarantee the Service will be uninterrupted, error-free, or that any specific content, collection, or feature will remain available indefinitely.

10. Limitation of liability

To the fullest extent permitted by law, Tidal Takes and its owners will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of profits, data, or business opportunities. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose.

Nothing in these Terms limits liability where it cannot be limited under applicable law.

11. Termination

We may suspend or terminate your account if you violate these Terms, engage in fraudulent or abusive behaviour, or for any other reason at our reasonable discretion, with notice where practical. You may terminate your account at any time by cancelling your subscription and, if desired, requesting account deletion per our Privacy Policy.

12. Governing law

These Terms are governed by the laws of The Bahamas, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of The Bahamas, unless applicable law requires otherwise.

13. Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date and, where appropriate, notify members by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
